General terms and conditions
1. General
These General Terms and Conditions (GTC) are an integral part of the contractual relationship between you (hereinafter referred to as “Guest”) and easyAlps Beherbergungs GmbH, 3818 Grindelwald (hereinafter referred to as “easyAlps”).
2. Conclusion of contract
Bookings can be made via our website (www.elements-lodge.ch) or external booking platforms. The accommodation contract is deemed to have been concluded upon confirmation of the booking by easyAlps or the booking platform. These GTC and the respective booking confirmation form an integral part of this contract. Anyone making a booking for additional persons is jointly liable for their obligations under the contract. Regardless of the booking channel used, the contract is concluded exclusively between the guest and easyAlps.
3. Prices / Minimum rental period
The prices published on the easyAlps website or on the booking channel used (e.g., Booking.com, Airbnb, e-domizil) apply. By making a booking, the guest accepts the corresponding price. In the event of prices being published in error, easyAlps reserves the right to adjust them. In this case, the guest will be informed within 48 hours of booking and may withdraw from the contract free of charge within 24 hours. Further claims are excluded. We reserve the right to make adjustments in the event of newly introduced or increased government charges (e.g., VAT, visitor's tax), exchange rate changes, or obvious printing errors, as well as minimum rental periods.
4. Payments
For bookings made via the easyAlps website, the total amount excluding tourist taxes is due directly at the time of booking. The tourist tax must be paid before checking into the room. For bookings made via external booking platforms, the respective payment formalities of the platform apply. For bookings made via third-party platforms, the payment process is handled by the respective platform. easyAlps has no influence on the terms of payment or the time of payment.
5. Cancellation conditions
Cancellations must be made in writing. For bookings made via external platforms, the respective cancellation conditions of the platform apply. For direct bookings made via the website, different cancellation conditions apply, depending on the selected room rate: Non-cancellable rate: • No free cancellation possible. • 100% of the costs are due upon booking and will not be refunded under any circumstances, regardless of the reason for cancellation or the time of cancellation. • Rebookings, postponements, or refunds are not possible. Cancellable rate: • Free cancellation up to 14 days before arrival. • 14 to 8 days before arrival: CHF 100 processing fee. • Less than 8 days before arrival: 100% of the total cost. No-shows without notification are considered cancellations on the day of arrival. Rebookings are subject to the same conditions. Any refunds will be made using the same payment method. External payment fees may apply. For bookings made less than 14 days before arrival, the statutory right of withdrawal does not apply as the service is about to commence.
6. Arrival and departure
Arrival is independent using an access code. The exact address and code will be provided in advance. Unless otherwise agreed in writing, check-in is from 4 p.m. and check-out is by 10 a.m. at the latest. In the event of late departure, a fee of up to CHF 100 per hour or part thereof may be charged. For arrivals after 10 p.m. and departures before 7 a.m., the quiet hours as specified in section 7 apply. Parking spaces are provided without guarantee; liability is limited to the extent required by law.
7. Obligations and Liability of the Guests
The rental property may only be occupied by the number of persons specified in the booking confirmation. In the event of overbooking, easyAlps may refuse to hand over the property or charge CHF 60 per person/night. The accommodation must be treated with care; quiet hours apply from 10:00 p.m. to 7:00 a.m. Damage and defects must be reported immediately. The property must be returned in the condition it was found, including all inventory. The guest is responsible for cleaning dishes/cutlery. The guest is liable for any damage caused unless they can prove they are not at fault. Pets are only allowed with the prior written consent of easyAlps. Smoking is prohibited throughout the accommodation. A special cleaning fee may be charged in the event of non-compliance. The guest who made the booking is fully liable for any damage caused by pets. easyAlps reserves the right to refuse or cancel group bookings such as bachelor parties or bookings by persons under the age of 18 unaccompanied by adults. Bookings by or for minors under the age of 18 traveling alone are not permitted. Exceptions can only be made with the written consent of the parents. Extra beds or additional persons will be charged at an additional rate depending on age and room category. Details will be provided in the booking confirmation. The guest undertakes to comply with fire safety regulations. Decorations or electronic devices may only be installed with the express consent of easyAlps. Commercial use or subletting of the accommodation by the guest is not permitted.
8. Cleaning
Final cleaning is carried out by easyAlps. An additional fee may be charged for excessive cleaning. Intermediate cleaning is not included but can be carried out for a fee and upon prior notification.
9. Impossibility of Fulfilling the Contract
In the event of unforeseeable or unavoidable events (e.g., natural disasters, political unrest), easyAlps may terminate the contract before or during the stay. There is no liability for damages. Payments already made will be credited in the form of a voucher, provided the guest agrees. Otherwise, the amount will be refunded via the original payment method.
10. Complaints
Defects or complaints must be reported to easyAlps immediately upon arrival. If this is not done, it will be assumed that the property is in good condition. Claims for damages must be made in writing within 14 days of departure and include supporting evidence. This is only possible if the defects were reported to easyAlps during the stay. Claims for reduction or compensation are only valid if the defect was reported during the stay and easyAlps did not remedy it. After this period, all claims expire.
11. Liability for Third-Party Services
easyAlps accepts no liability for the performance or quality of services provided by external partners (e.g., ski schools, taxi companies, leisure activities) that are merely arranged by easyAlps.
12. Data Protection
Personal data is processed in accordance with the Swiss Data Protection Act (DSG) and, where applicable, the EU GDPR. The guest consents to the processing of their data for the purpose of fulfilling the contract and for marketing purposes, unless they object to this. Data will only be passed on to contracted service providers. An access log is kept for electronic access systems. Recordings from surveillance cameras are stored in accordance with legal requirements. Newsletters or advertising by email will only be sent with the express consent of the guest.
13. WI-FI
Use of Wi-Fi is free of charge. By using Wi-Fi, the guest accepts the additional terms of use at: www.elements-lodge.ch/nuetzliches/wlan. (The terms of use are currently only available in German.) Illegal use (e.g., copyright infringement) is prohibited and may be reported to the authorities.
14. Liability
Liability for indirect or consequential damages is excluded. easyAlps is liable for direct damages up to a maximum of the rental price, except in cases of gross negligence or intent. Liability for auxiliary persons is excluded to the extent permitted by law.
15. Vouchers
Vouchers can only be redeemed within their period of validity. The period of validity is 2 years from the date of issue. Cash payment is excluded. Vouchers must be mentioned before booking.
16. Credit Card Charges
By providing their credit card details, guests agree that the corresponding amount may be charged in the event of a no-show or damage caused.
17. Use of Logos and Image Material
The use of the name, logo, or image material of easyAlps for advertising or publication purposes is only permitted with the written consent of easyAlps. In the event of non-compliance, easyAlps reserves the right to withdraw from the contract and claim damages.
18. Video Surveillance
If video surveillance is carried out in the o utdoor or entrance areas, this will be done in accordance with legal requirements. The data is used exclusively for security purposes and will only be passed on if required by law.
19. House Rules and Expulsion in the Event of Miscounduct
easyAlps reserves the right to exclude guests from their stay in the event of gross misconduct (e.g., significant disturbance of the peace, repeated violation of the rules, or wilful damage to property). In this case, there is no entitlement to a refund.
20. Severability Clause
Should individual provisions of these terms and conditions be invalid or void, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that comes as close as possible to the economic purpose of the invalid provision.
21. Applicable Law / Place of Jurisdiction
Swiss law applies exclusively. The place of jurisdiction is Interlaken. In the event of disputes, the German version of these terms and conditions is binding. Mandatory places of jurisdiction remain reserved.
22. Emergencies and Lost Items
In the event of an emergency (e.g., fire, water damage, burglary), the responsible authorities and easyAlps must be informed immediately. easyAlps accepts no liability for items left behind. Upon request, found items will be returned to the guest at their expense.
23. Written Form
Changes or additions to this contract must be made in writing. Verbal side agreements are not binding.
24. Language
In the event of disputes, the German version of these terms and conditions shall be authoritative.
